§ 1-2.01. Violations. Misdemeanor or Infraction.

  • It shall be unlawful for any person to violate, or to fail to comply with, any provisions of this Code or of any code adopted by reference by this Code. Notwithstanding any other provision of this Code, any person violating or failing to comply with any such provision shall be guilty of a misdemeanor, except that when the City Attorney shall elect to charge such violation as an infraction, it shall be an infraction. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this Code is committed, continued or permitted by such person and shall be punishable accordingly. Any person convicted of a misdemeanor under the provisions of this Code shall be punishable by a fine of not more than one thousand dollars ($1,000.00), or by imprisonment in the County Jail of the County of Stanislaus for a period not more than one (1) year, or by both such fine and imprisonment. Any person convicted of an infraction shall be punishable by a fine not exceeding five hundred dollars ($500.00) for each offense.

    In addition to the penalties hereinabove provided, any condition caused or permitted to exist in violation of any of the provisions of this Code is deemed a public nuisance and may be, by this City, summarily abated; and each day such condition continues shall be regarded as a new and separate offense.
