§ 1-2.01.1. Misdemeanor: Two or More Violations.

  • Violation of any provision of this Code which is specifically made an infraction shall be a misdemeanor if a defendant has been convicted of one (1) or more violations of the same Code provision within the twelve (12) month period immediately preceding the commission of the offense and such prior conviction is alleged in the accusatory pleading and proven or admitted. For this purpose, a bail forfeiture shall be deemed to be a conviction of the offense charged.
