§ 4-16.401. Shopping Cart Retrieval Services Required; Filing of Notification with City.

  • (a)

    Every business in the City of Modesto that uses shopping carts must contract with a cart retrieval service and notify the City as to with whom they are contracted. The cart retrieval services must pick up the carts that have been reported to them within three (3) business days of receipt of notice from the City.

    (b)

    All retrieval service companies that have contracts with businesses located in the City of Modesto must register with the City in accordance with Section 4-6.501.

    (c)

    Within sixty (60) days of the effective date of the ordinance codified in this chapter, every business establishment must file a notification form with the City, on a form established by the City, setting forth the name of the cart retrieval service to be used by that establishment. In the event that there is a change in the listed cart retrieval service used, a business establishment shall file a new notification form with the City within ten (10) days of the effective date of the change.

    (d)

    As set forth in this chapter, there will be no charge to the business owner if a cart impounded at the corporation yard is picked up within three (3) business days after being notified by the City. If the shopping carts are not retrieved, then all applicable impound fees shall apply.
