Article 5. Nonconforming Uses, Structures and Sites, And Lots |
§ 10-3.505. Amortization of Nonconforming Prohibited Uses.
Notwithstanding Section 10-3.502 any use of real property existing on the effective date of the ordinance codified in this article, which was constructed, operated, and maintained in compliance with all previous regulations, but which has been determined to be a prohibited use in accordance with Section 10-3.210 shall be regarded as a nonconforming use which may be continued until six (6) months after the effective date of the ordinance prohibiting such use. On or before such latter date, all such nonconforming uses shall be terminated unless an application for extension of time has been approved in accordance with the provisions of Section 10-3.506.
(a)
Abandonment. Notwithstanding the above, any discontinuance or abandonment of a use as set forth above, shall result in a loss of legal nonconforming status of such use.
(b)
Amortization B Annexed Property. Any use of real property which was a legal use at the time of annexation of the property and which is located in the City, but which does not conform to the provisions of Section 10-3.210 shall be terminated within six (6) months of the date of annexation unless an application for extension of time has been approved in accordance with the provisions of Section 10-3.506.
